Southwestern Ontario Debt Relief: End Money Stress and Start Fresh Today
Debt management is hard work even in calm conditions. But add in a high cost of living, shaky job insecurity, and housing prices, and that task gets even taller. It seems like whoever you ask, many households in London, Windsor, Chatham-Kent, and St. Thomas are feeling the squeeze. So to help out our neighbors, this article breaks down the common Southwestern Ontario debt relief options, from Bankruptcy and Consumer Proposals to Credit Counselling and Debt Consolidation. Let’s take a closer look:
What is a Licensed Insolvency Trustee (LIT)?
Step one, debt relief starts with a Licensed Insolvency Trustee (LIT). We are federally regulated debt professionals licensed by the Office of the Superintendent of Bankruptcy (OSB). Only Licensed Insolvency Trustees are authorized to file Consumer Proposals and Bankruptcies in Canada.
At Adamson & Associates, each initial consultation is free and confidential. We will assess your income and your financial responsibilities, and then advise the most appropriate option for you — whether that be restructuring your finances, negotiating with creditors, or making repayment agreements. It all begins with that first meeting.
Debt Relief Options Available in Southwestern Ontario
With a full understanding of your finances, we tailor a solution to your needs. There are four common options, each designed to address different financial situations.
1. Consumer Proposal
A Consumer Proposal is one of the most popular debt relief options in the Southwestern Ontario area. It offers you the opportunity to repay some part of what you owe to your creditors with convenient payments. Payment plans cannot exceed five years, and all collection calls and wage garnishments will stop immediately. It’s a structured, legally backed path out of debt, with several protections built in:
- Consolidates unsecured debts into one monthly repayment.
- Prevents accumulation of interest charges.
- Protects assets from seizure.
- Avoids the need for Bankruptcy.
- Licensed and regulated by the Canadian Government.
To qualify for a Consumer Proposal, your total debts must not exceed $250,000 (excluding a mortgage secured by your main residence).
2. Bankruptcy
If you are facing more extensive financial difficulties, then Bankruptcy might be the best way to gain financial liberty. Believe it or not, a Bankruptcy can be an easy process if completed with the expertise and professionalism of a Licensed Insolvency Trustee.
When filed, Bankruptcy offers immediate protection from creditors and collection agencies. You’ll make timely payments according to your income, and most unsecured debts will be wiped out at the end. If you’re filing for Bankruptcy for the first time, the timeline depends on surplus income (income above the government-set threshold). If you are below the threshold, discharge will happen automatically after 9 months. If you have to make surplus payments, your Bankruptcy will extend to 21 months.
Bankruptcy is not failure; rather, it’s a process that provides Canadians with a fresh start.
3. Debt consolidation
Debt consolidation takes all of your separate debts and combines them into one convenient monthly payment (hopefully with a lower interest rate). You must qualify for a consolidation loan, which is not guaranteed.
If credit damage has dented your credit score, or if high-interest loans are causing problems, a Licensed Insolvency Trustee can discuss with you how a Consumer Proposal might realize similar or even better outcomes compared to more conventional consolidation approaches.
4. Credit counselling
Credit counselling can assist those who are still making payments to create a more realistic budget and a structured repayment plan. A credit counsellor may negotiate reduced or paused interest with creditors, although all participating creditors must agree, and some debts (like government debt) may not be included.
Credit counselling is not a government-licensed insolvency process, and counsellors are unregulated, meaning that there may be associated fees.
Consider a free consultation with a Licensed Insolvency Trustee to select the best option for your situation.
